We Can Help Estheticians

The beauty industry relies heavily on aestheticians. Their services include facials, microdermabrasion, chemical peels, waxing, and other beauty treatments. A skincare professional must have knowledge of a variety of skin care techniques in order to provide safe and effective treatments.
Some clients can react poorly to treatments provided by estheticians, and not all esthetician services are appropriate for everyone. In response to a complaint from a client, the Board of Barbers and Cosmetology may investigate your esthetician business and you. We at Licensure can assist estheticians like you in defending themselves from disciplinary actions and resolving the matter so you can keep your job.

Estheticians' Licensing Problems

There is a lot of work involved in becoming a licensed esthetician. A beauty school may require hundreds of hours of coursework, a licensing exam, and application fees depending on your state's requirements. Continuing education courses are required by some states for estheticians in order to stay current with requirements and skills.
After getting licensed, estheticians must follow their state's licensing agency's guidelines and standards. Unless their business meets these standards, their state may investigate and discipline them. Estheticians often face discipline for the following reasons:
Failure to pass inspections- The Board, as an arm of the Commonwealth of Virginia, may inspect your business without notice to you or regularly. The Board may discipline you if you fail these inspections or violate multiple laws.

• Bad sanitation and hygiene practices- Estheticians work with people's skin and perform invasive treatments that can spread germs and diseases. Violations can result from improperly cleaned equipment.

Poor storage and handling of sanitary items - If you store and handle items in an unsanitary way, reuse single-use items, or fail to dispose of hazardous waste properly this can put you under fire and start disciplinary action.

Going outside the scope of your esthetician license - You're not allowed to diagnose or treat disease, which is a way of practicing outside the scope of your license. Estheticians are not medical professionals. Your esthetician's license could be suspended or revoked if your business violates your license.

Incompetence and negligent acts - There are many treatments provided by estheticians that have the potential to harm or injure their clients due to negligence or incompetence. An injured client may complain about your license if you fail to take proper care of them

.
You may have to deal with a customer complaint or an investigation into your business for a variety of reasons, including unprofessional behavior and failure to meet Virginia's standards. Investigating complaints can result in disciplinary actions such as suspensions or revocations of your license if a complaint has merit.
But, investigations don't always result in serious disciplinary penalties such as losing your license. Additionally, fines and other penalties may also be imposed. Attorney Tori Bramble can help you defend a complaint against your license so you can protect your livelihood and resolve complaints made against your esthetician's license.

License defense for estheticians

Throughout an esthetician's career, you'll get complaints even if you do everything right. It's impossible for an esthetician to make every client happy, and some clients complain out of spite or in retaliation. A surprise inspection might turn up a bunch of minor violations on a busy day. A state licensing board investigation can be scary, no matter what the reason is.
Disciplinary actions can affect your license if you make a complaint or violate a state inspection rule. The Board decides whether to investigate the complaint. An investigator may come and talk to you or visit your business if that's the case. Other options include talking to the person who filed the complaint, interviewing work colleagues and others, and reviewing security footage. After the investigation is complete, the Board will make its decision and inform you of the outcome. If found guilty, you may be required to pay a fine, attend seminars, or lose your license.
The charges against you and the evidence will be discussed at the hearing after the investigation. The Board may offer you a consent order asking you to admit to the charges and accept the disciplinary action. If you sign the consent order, you'll avoid the hearing but it'll go on your permanent disciplinary record. Before you sign a consent order, talk to an attorney about your legal rights.
During the hearing, you'll be able to tell your side of the story to the Board of Barbers and Cosmetology. It might be possible for you to present evidence and make arguments against discipline. At this hearing, you can have an attorney represent you.
